Introduction
Welcome to Events by Tahimy, a premium event planning service operated by Verum Realty LLC dba Events by Tahimy. By engaging with our services, you are agreeing to abide by the following Terms of Service. Please review these terms carefully to understand your rights and obligations.
Payment Terms
Deposit: A deposit of 50% of the estimated cost of the event is required upon signing the Services Agreement.
Final Payment: The remaining balance for our event planning services must be settled no later than two weeks prior to the event date. Failure to do so may result in cancellation of services without any refund.
Payment Methods: Payments can be made through Cash, Check, Debit or Credit Card. All payments are final and non-refundable.
Third-Party Vendors: Payments made directly to third-party vendors are governed by the respective vendors' terms and conditions. Events by Tahimy is not responsible for any issues arising from transactions with third-party vendors.
Refunds: All payments are final and not subject to refunds.
Termination
Clients may terminate the agreement by providing written notice at least 30 days prior to the event date. Any deposits or payments made are non-refundable as per the Payment Terms section of this agreement.
Service Limitations
Events by Tahimy is committed to delivering exceptional event planning and management services. However, we are not liable for third-party vendors' performance, conduct, or deliverables. Clients are responsible for settling disputes or issues directly with the respective vendors.
User Conduct
Clients are expected to provide accurate and complete information during the planning process. Clients must also adhere to agreed-upon schedules and deadlines to ensure the successful execution of the event. Failure to comply may result in additional fees or termination of services without refund.
Intellectual Property
Events by Tahimy does not hold any rights to intellectual property related to photography, videography, or any other creative works produced during the event, which are paid services by the Customer. These are subject to the terms and conditions of the respective third-party vendors.
Media Usage
Events by Tahimy may use photos and video footage taken by its staff and subcontractors (not paid for by the Customer) for social media, website, and marketing purposes. Customers who wish to opt-out of this must send an explicit request via email to contact@tahimy.com at least 72 hours prior to the event.
Limitation of Liability
Events by Tahimy is not liable for any requirements not explicitly outlined in the Services Agreement's Exhibit A (Estimate). Any additional services or changes that are not included in the initial estimate may incur additional costs.
Dispute Resolution
In the unlikely event of a dispute, both parties agree to engage in good-faith negotiations to resolve the issue. If a resolution cannot be reached, the dispute will be settled through binding arbitration in the State of Florida, under Florida law. Each party will be responsible for their own arbitration fees, and the arbitrator will be mutually selected by both parties.
Governing Law
These Terms of Service are governed and interpreted in accordance with the laws of the State of Florida. Any legal actions or proceedings shall be brought exclusively in the courts of Miami-Dade County, Florida.
General
Changes to Terms: Events by Tahimy reserves the right to change, modify, or revise these Terms of Service at any time. Any changes will become effective immediately upon being posted on our website. It is the client's responsibility to review these Terms regularly. Continued use of our services after changes to these Terms constitutes agreement to those changes
